• You are solely responsible for verifying food safety for yourself and others
• ChewIQ does not guarantee the accuracy of restaurant information, hours, or availability

If you have severe food allergies or medical dietary requirements, always consult with the restaurant staff and your healthcare provider before consuming any food.

Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

Account Termination

We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for extended periods. You may delete your account at any time through the app settings.

• Annual: $39.99/year (equivalent to $3.33/month)

Billing Terms

• Subscriptions renew automatically unless canceled at least 24 hours before the renewal date
• Payment is charged to your App Store, Google Play, or payment method on file
• Manage or cancel subscriptions through your device's app store settings or account settings
• No refunds for partial subscription periods unless required by applicable law
• Prices may change with notice; existing subscribers will be notified before renewal at new rates

Free Trial

If offered, free trials automatically convert to paid subscriptions unless canceled before the trial ends. You may only use one free trial per account.

ChewIQ uses artificial intelligence and third-party services to provide our features. By using our Services, you acknowledge:

AI Technology

• Our AI features are powered by third-party AI providers including Google and OpenAI
• AI-generated content (recipes, explanations, recommendations) may contain errors or inaccuracies
• AI responses are not professional advice (medical, nutritional, or otherwise)
• Your interactions with AI features may be used to improve our Services

Third-Party Integrations

We integrate with various third-party services including:

• Restaurant data providers (Yelp, OpenTable)

You agree not to:

Content Standards

You agree that your content will not:

• Violate any third party's intellectual property or privacy rights
• Contain false, misleading, or deceptive information
• Include profanity, hate speech, or discriminatory content
• Contain spam, advertisements, or promotional material
• Include malicious code or harmful content

Content Moderation

We use automated systems and human review to moderate content. We reserve the right to remove any content that violates these Terms without notice.

Menu Contributions

When you contribute menu data (photos, corrections, additions), you grant us a perpetual license to use this data to improve our Services for all users.

All ChewIQ content, features, functionality, branding, and technology are owned by ChewIQ and protected by intellectual property laws. This includes:

• The ChewIQ name, logo, and brand elements
• App design, user interface, and user experience
• AI models, algorithms, and processing methods
• Curated content, insights, and educational materials
• Source code and technical infrastructure

You may not copy, modify, distribute, or create derivative works without our written permission.

By creating an account, you agree to receive communications from ChewIQ, including:

• Transactional emails: Account verification, password resets, subscription confirmations
• Service updates: New features, important changes, and maintenance notices
• Marketing communications: Tips, promotions, and personalized recommendations

You may opt out of marketing emails at any time by clicking "unsubscribe" in any email or adjusting your notification preferences in the app. Transactional emails related to your account cannot be opted out of.

By using our Services, you consent to the collection and processing of data including dietary preferences, location data, usage patterns, and food-related information to provide personalized experiences.

We do not warrant that:

• The Services will be uninterrupted, secure, or error-free
• Results obtained will be accurate or reliable
• Any errors will be corrected
• The Services will meet your specific requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHEWIQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Personal injury or health issues related to food consumption
• Allergic reactions or adverse health effects
• Inaccurate restaurant or menu information
• Service interruptions or data loss

Our total liability shall not exceed the greater of $100 or the amount you paid for the Services in the 12 months preceding the claim.

You agree to indemnify and hold harmless ChewIQ and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third party's rights.

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.

• Entire Agreement: These Terms constitute the entire agreement between you and ChewIQ regarding the Services.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
